Terms of Use, Rental Terms, and Liability

1. About the Sports complex

The Sunday Village Sports Complex is an indoor, multi-purpose sports facility equipped to host both recreational and competitive sporting events.

2. Reservation and rental procedures

2.1. Use of the sports complex is subject to prior reservation through the Sunday Village administration by calling +38 (067) 616-73-05.

2.2. When making a reservation, please specify:

– the date and desired start and end times of the session;

– the sport or type of event;

– the number of participants;

– required equipment (if rental is needed);

– contact phone number and full name of the person in charge.

2.3. Rates for renting the sports complex and equipment are set in accordance with the Sunday Village price list and can be clarified with the administration.

2.4. The equipment rental fee includes the use of the appropriate field or table for the selected sport.

2.5. A booking confirmation is sent to the User via SMS or phone call after the prepayment is made (as agreed with the administration).

2.6. Reservations may be canceled without penalty no later than 24 (twenty-four) hours before the start of the event. If canceled later, 50% of the reservation cost will be retained as compensation.

2.7. The sports complex may be reserved for sports competitions, tournaments, corporate events, and team activities. Terms and prices for group reservations are negotiated individually.

3. Rules of conduct and safety

3.1. General Requirements

3.1. Before the start of a session, the User must check in at the front desk or with the designated staff member and confirm their reservation.

3.2. All participants must comply with these Rules, the instructions of Sunday Village staff, and the applicable laws of Ukraine.

3.3. Persons under the influence of alcohol, drugs, or toxic substances are not permitted in the sports complex.

3.4. The responsible person (renter) is required to inform all event participants of these Rules.

3.2. Requirements for sports clothing and footwear

3.5. Visitors are required to wear clean sports shoes with soles that do not leave marks on the gym floor.

3.6. Sportswear must be appropriate for the chosen sport. It is recommended to use protective gear (knee pads, elbow pads, protective gloves, etc.) in accordance with the sport and individual needs.

3.3. Rules for using the gym

3.7. The following are PROHIBITED throughout the sports complex:

– entering the facility in outdoor footwear, except in the stands area;

– eating food directly on the playing field and in the stands;

– consuming alcoholic beverages and smoking anywhere in the facility (including the stands and locker rooms);

– bringing glassware into the sports hall and the stands;

– bringing pets into the facility;

– using profanity, behaving aggressively, or humiliating other participants or staff;

– move or set up sports equipment (nets, stands, tables) on your own without consulting the staff;

– use the sound system (mixer, amplifier, microphone) without consulting the administration;

– occupy the stands beyond the established capacity (96 people).

3.8. Visitors are required to keep the hall, changing rooms, showers, and restrooms clean and tidy. Trash must be disposed of in the designated bins.

3.9. If any equipment malfunctions or hazardous situations are detected, the User is required to immediately notify staff. Attempting to fix malfunctions on your own is PROHIBITED.

3.4. Safety during training

3.10. It is recommended to warm up before starting a session to prevent injuries. Sunday Village is not liable for injuries sustained as a result of disregarding basic sports safety rules.

3.11. When engaging in sparring, contact sports, and advanced gymnastics exercises, the presence of a spotter or coach is mandatory.

3.12. Individuals with chronic cardiovascular or musculoskeletal conditions, or other health limitations, may participate in activities at the sports complex only with a doctor’s approval and at their own risk.

3.13. Parents or legal guardians are responsible for the safety of minor participants. Minors are admitted to the sports complex only when accompanied by adults or under the supervision of a coach.

4. Sports equipment rental

4.1. Sports equipment is available for rent in accordance with the Sunday Village price list.

4.2. Equipment available for rent:

– soccer balls (futsal);

– volleyballs;

– tennis rackets and balls (tennis);

– basketballs;

– table tennis rackets and balls;

– other equipment — upon request (please specify when booking).

4.3. The condition of the equipment is checked in the User’s presence before it is issued. The User confirms the equipment is in good working order by signing or verbally upon receipt.

4.4. Equipment must be returned in the same condition as when issued—clean and undamaged. Return time—no later than the end of the paid rental period.

4.5. The User bears full financial responsibility for the loss or damage of rental equipment based on the Inspection Report and the Sunday Village price list.

5. Liability and compensation for damages

User Liability

The User bears full financial liability for any damage caused to the sports complex’s property and rental equipment through his or her own fault or the fault of participants he or she has invited.

5.1. In accordance with Article 1166 of the Civil Code of Ukraine, the User is obligated to fully compensate for damage caused to Sunday Village’s property unless they can prove their lack of fault.

5.2. The User’s liability extends to:

– damage to the hall’s playing surface (scratches, cuts, shoe marks, etc.);

– damage to or destruction of sports equipment (nets, stands, basketball backboards, goals, tables);

– damage to rental equipment (rackets, balls, etc.);

– damage to sound equipment (amplifier, mixer, microphone) due to unauthorized or improper use;

– damage to seats, fences, or grandstand structures;

– damage to lighting fixtures;

– littering or damage to locker rooms, showers, and restrooms.

5.3. Procedure for recording and compensating for damages:

– Upon discovering damage, Sunday Village staff will prepare an Inspection Report in the presence of the User;

– The Report shall be signed by both parties; if the User refuses to sign, it shall be prepared in the presence of two witnesses;

– the amount of damages is determined based on the Inspection Report and Sunday Village’s price list or based on the conclusion of an independent appraiser—at Sunday Village’s discretion;

– a claim for compensation must be submitted no later than 24 (twenty-four) hours after the end of the rental period;

– compensation shall be paid by the User no later than the date of departure or within a timeframe agreed upon with the administration.

5.4. Physical injuries sustained by participants during activities at the sports complex as a result of their own negligence or violation of safety rules do not constitute grounds for filing claims against Sunday Village.

5.5. Sunday Village is liable for damage caused by a malfunction of the facility’s fixed equipment (flooring, structures, lighting), provided that the User complied with safety rules and notified staff of the malfunction before the start of the session.

5.6. In the event of disputes regarding the amount of damages, the parties shall resolve them through negotiations or in court in accordance with the current legislation of Ukraine. The statute of limitations is 3 (three) years (Art. 257 of the Civil Code of Ukraine).

6. Use of the sound system and stands

6.1. The sports complex’s sound system (amplifier, mixer, microphone) is made available for use subject to separate approval by the administration at the time of booking.

6.2. Use of the sound system without prior approval is PROHIBITED. Independent connection or adjustment of the amplifier and mixer is prohibited.

6.3. The sound level must not exceed limits that disturb the comfort of other Sunday Village guests. The sound system may only be used during the reserved time slot.

6.4. The stands are designed to accommodate 96 spectators. Exceeding the stands’ capacity is PROHIBITED for safety reasons. Access to the field from the stands during an event is permitted only with the organizer’s or staff’s permission.

7. Hosting tournaments and organized events

7.1. The sports complex may be rented for hosting sports tournaments, championships, corporate events, or team events.

7.2. To hold organized events, you must:

– contact the administration no later than 10 (ten) days before the event date;

– agree on the duration, number of participants, and spectators;

– sign a rental agreement and pay a deposit;

– agree on the terms of use for the sound system and bleachers.

7.3. The event organizer is responsible for ensuring that all participants and spectators comply with the sports complex’s rules.

7.4. Sunday Village reserves the right to refuse to host or to terminate an event early in the event of a violation of these Rules or public order regulations.

8. Actions to take when an air raid alarm is sound

8.1. When an air raid alarm is sounded, all participants and spectators must immediately:

– stop their activities and leave the playing field;

– leave the sports complex in an orderly manner under the guidance of staff;

– proceed to the nearest shelter—the first floor of the Sunday Apart Hotel building—in accordance with the evacuation plan.

8.2. Sports complex staff and the event organizer are required to organize a safe and rapid evacuation of all participants and spectators.

8.3. The sports complex resumes operations after the air raid siren is lifted and a 30-minute waiting period has elapsed. Time spent in the shelter is not counted as rental time and is not charged.

8.4. The evacuation plan is posted at the entrance to the sports complex and on the walls of the hall.
