Agreement for the provision of temporary accommodation services

We are pleased to welcome you to our website and invite you to stay at Sunday Village.
We invite you to review the terms of this Agreement for the Provision of Temporary Accommodation Services, which constitutes our public offer to you.
Under this Agreement, accommodation services are provided to Users for the purpose of their temporary stay (hereinafter referred to as “Accommodation” or “Stay” or “Accommodation (Stay)”):
– In separate comfortable residential buildings (cottages) (hereinafter referred to as “Cottages”).
– In separate rooms located in the Sunday Apart Hotel building (hereinafter referred to as “Sunday Apart Hotel Rooms”).
– In separate rooms located on the second floor of the Sunday Village administrative building (hereinafter referred to as “Administration Rooms”).
All accommodation options are located at the following address: Bugova Street, the village of Novoselivka, Tulchyn District, Vinnytsia Region (hereinafter referred to as the “Sunday Village premises”).
1. General provisions of the agreement
1.1. The Agreement on the Provision of Temporary Accommodation Services (Public Offer) (hereinafter referred to as the “Agreement” or “Public Offer”) sets forth the essential terms and conditions for the provision of the relevant services, in accordance with Article 641 of the Civil Code of Ukraine, and constitutes an official public offer addressed to an indefinite group of persons (hereinafter referred to as the User or Users) to enter into this Agreement for the provision of temporary accommodation services involving the provision of a residential house (cottage), or several houses (cottages), or a Room (rooms) at Sunday Apart Hotel, or a Room (rooms) at the Administration for the temporary accommodation of persons (hereinafter referred to as the “Services”) under the terms set forth below.
1.2. Sunday Village and the User mutually warrant to each other that they possess the necessary legal capacity, as well as all rights and powers necessary and sufficient to enter into and perform the terms of this Agreement.
1.3. The text of this Agreement is posted on the official Sunday Village website at the following link: https://sunday-village.com.ua/public-offer/ (hereinafter referred to as the “Sunday Village website”) and constitutes the official and current version of this Agreement.
1.4. In accordance with the Law of Ukraine “On the Protection of Personal Data” No. 2297-VI, the User grants Sunday Village consent to process their personal data under the following conditions:
– Purpose of processing: performance of this Agreement, maintenance of fiscal and registration records, and ensuring security on the premises of Sunday Village.
– Scope of data: last name, first name, patronymic, date of birth, contact phone number, email address, details of the identity document.
– Third parties: government authorities (exclusively upon their lawful written request); payment systems (exclusively for processing payments under the Agreement).
– Retention period: 3 (three) years from the date of the User’s check-out or until the User revokes their consent to the processing of personal data.
– The User’s rights as a data subject: the right to access, correct, or delete their data, as well as the right to object to processing—by sending a written request to the email address sundayvillage.manager@gmail.com.
– Consent may be withdrawn by the User at any time in writing. Withdrawal of consent does not affect the lawfulness of processing carried out prior to withdrawal.
1.5. If the User accepts the services offered by Sunday Village, it is deemed that the User fully and unconditionally agrees to all the terms and conditions of this Agreement and the Rules of Stay posted on the Sunday Village website and at the Sunday Village reception desk (hereinafter referred to as the “Rules of Stay”), and fully and unconditionally accepts them, agreeing to fulfill all obligations imposed on the User by this Agreement and the Rules of Stay.
2. Offer (Public Offer) / Subject matter of the agreement
2.1. The subject matter of this Agreement (public offer) is the provision by Sunday Village to the User, for a fee, of accommodation services by providing a residential building (cottage), or several residential buildings (cottages), or a Room (rooms) at Sunday Apart Hotel, or a Room (rooms) at the Administration for temporary accommodation at the address: Vinnytsia Region, Tulchyn District, village of Novoselivka, Bugova Street, in accordance with the booking request (if such a booking was made).
2.2. The Agreement is deemed concluded from the moment the User performs any action provided for in clause 3.4 of this Agreement, which signifies the User’s full and unconditional acceptance of all terms of this Agreement without any exceptions, reservations, and/or limitations in accordance with Article 642 of the Civil Code of Ukraine.
The Agreement is concluded by the User through acceptance of a public offer, i.e., the User’s performance of any action provided for in Section 3.4 of this Agreement, and is legally binding on the User and Sunday Village in accordance with Article 642 of the Civil Code of Ukraine, and is equivalent to an agreement set forth on paper and signed by the User and Sunday Village. At the same time, the User and Sunday Village may, at the initiative of either party, conclude and sign this Agreement in paper form.
3. Procedure for entering into the agreement
3.1. The Agreement is entered into between Sunday Village and the User through the acceptance of a public offer.
3.2. Acceptance of the public offer occurs when the User performs any of the actions specified in Section 3.4 of the Agreement.
3.3. Conclusion of the Agreement means that the User:
– has fully reviewed and agrees to this Agreement, undertakes to comply with it, and ensures that both the User and their guests comply with the provisions of the Agreement and the Rules of Stay;
– accepts all terms of this Agreement without comments, reservations, or objections.
3.4. In accordance with Article 642 of the Civil Code of Ukraine, the User confirms acceptance of the Agreement (public offer) by performing any of the following actions:
– payment for temporary accommodation services in one of the following ways: by non-cash means—via bank transfer to the Sunday Village account, or by bank card; or in cash—at the Sunday Village reception desk;
– the User’s direct use of Sunday Village services;
– completion and signing of the Registration Form at the Sunday Village reception desk.
3.5. The User agrees to provide accurate and valid personal data and information upon registration and assumes full responsibility for the accuracy of such data and information provided about themselves.
3.6. The term of acceptance of this Agreement (public offer) is unlimited.
4. Payment terms
4.1. The services under this Agreement are provided to the User on a paid basis, in accordance with the terms of this Agreement and the rates/prices listed on the Sunday Village website, at the front desk, or in the price list, rate card, other informational materials of Sunday Village (hereinafter referred to as “Rates/Prices” or “Sunday Village Rates/Prices”), taking into account the selected service. The rates/prices for services under this Agreement and their list are determined and may be changed solely at the discretion of Sunday Village.
4.2. The right to receive/use services from Sunday Village is generally granted after payment for the relevant services has been made, in accordance with the rates/prices. Sunday Village has the right to provide services to the User without prepayment, subject to a separate agreement between them.
4.3. Sunday Village has the right to apply flexible rates/prices and a discount system to the services it provides under this Agreement.
4.4. Payment for services under this Agreement may be made in cash, by Visa or Mastercard, or by bank transfer.
4.5. At the end of the paid accommodation period, the User is required to vacate the cottage(s) room(s) and clear them of personal belongings and luggage no later than 12:00 p.m. (Kyiv time) on the last paid day of stay, or pay for an extension of the stay provided that the cottage(s) or room(s) have not been booked by third parties.
4.6. Check-in begins at 3:00 p.m. (Kyiv time).
4.7. Early check-in and late check-out are additional services charged according to Sunday Village’s rates/prices. If checking out after 6:00 p.m. (Kyiv time), the full cost of one night’s accommodation must be paid.
4.8. If Sunday Village provides services without prior payment, the User is obligated to pay for such services on the day of check-in, in accordance with Sunday Village’s rates/prices.
4.9. In accordance with Article 268 of the Tax Code of Ukraine, the User is required to pay a tourist tax (to Sunday Village’s bank account or in cash) on the day of check-in, based on the number of guests and the number of nights of their temporary stay, at the rate established by a resolution of the Tulchyn City Council, but not exceeding the maximum amount specified in the Tax Code of Ukraine (for 2026 — up to 43.24 UAH/day for residents of Ukraine, up to 432.35 UAH/day for foreigners). The tax is paid upon check-in. Persons exempt from paying the tax are specified in subparagraph 268.2.2 of the Tax Code of Ukraine.
5. Reservations and cancellations
5.1. Reservations for Sunday Village residential buildings (cottages), or a Room (rooms) at Sunday Apart Hotel, or a Room (rooms) at the Administration, are made by submitting a request either on the Sunday Village website using the reservation form, or by phone, or via email (the Sunday Village email address is listed on the Contacts page of the Sunday Village website).
5.2. A reservation request made by phone or email must include the following information:
– the User’s first and last name;
– the check-in and check-out dates and times for the User and their guests;
– the desired accommodation area;
– the number of cottages, Sunday Apart Hotel rooms, or Administration rooms the User wishes to book;
– the number of the User’s guests and their ages;
– the User’s email address and phone number for contact purposes.
5.3. The maximum number of people that can be accommodated in a single cottage is 6 (six). Accommodation for children under 5 years of age is free of charge, provided that no separate bed or bedding is provided for them. Children over 5 years of age are accommodated on the same terms as adults.
5.4. The number of guests that can be accommodated in a room (or rooms) at Sunday Apart Hotel, or in a room (or rooms) at the Administration, is determined based on the capacity specifications of each individual room. Information regarding room specifications is provided in the booking system on the Sunday Village website.
5.5. The Sunday Village Administration shall confirm or decline the User’s reservation within 24 (twenty-four) hours of receiving the reservation request.
5.6. In the event of confirmation or rejection of the reservation, the Sunday Village Administration will send the User a notification of confirmation or rejection via email or SMS.
5.7. The Sunday Village Administration will confirm the User’s reservation request only if the required number of available cottages, Sunday Apart Hotel rooms, or Administration Rooms is available.
5.8. Upon confirmation by Sunday Village of the reservation request, the cottage, Sunday Apart Hotel room, or Administration Room is considered provisionally reserved.
5.9. A reservation is considered guaranteed if the User has made a prepayment equal to the cost of at least one night, or a longer period, of temporary accommodation for each reserved cottage, Sunday Apart Hotel room, or Administration Room.
5.10. A guaranteed reservation is held for the User until 12:00 PM on the day following the User’s check-in date.
5.11. Any other reservations are considered non-guaranteed.
5.12. Cancellation of a guaranteed reservation or a reduction in the number of guests, as well as a full or partial refusal of services, is accepted from the User only in writing by sending an email to the Sunday Village email address listed on the Sunday Village website.
5.13. The User has the right to cancel their reservation.
If the reservation is canceled no later than 10 days before the check-in date, the User will receive a refund of 100% of the amount previously paid.
If the reservation is canceled later than 10 days before the check-in date, or if the User fails to check in (failure to check in) on the day of arrival (check-in), Sunday Village will charge the User the cost of 1 (one) night’s temporary accommodation for each booked cottage, or Sunday Apart Hotel room, or Administration Room.
6. Procedure for arranging temporary accommodation
6.1. The provision of services to the User under this Agreement is generally subject to the User’s advance payment of the cost of temporary accommodation (lodging) for a period agreed upon with the Sunday Village reception desk in accordance with Sunday Village’s rates/prices, along with the User’s presentation of documents verifying their identity (Ukrainian passport, ID card, including for travel abroad, birth certificate—for persons under 14 years of age, passport of a foreign state or document of a stateless person, migration card, etc.) with the option for Sunday Village to make copies, as well as the User’s completion and submission of the Registration Form at the reception desk.
The Sunday Village administration reserves the right to request that the User’s guests present their documents to verify the completion of the Registration Form. All fields of the Registration Form are required. In the event of the objective absence of certain options (pets, vehicles, etc.), a dash shall be entered in the corresponding field of the Registration Form. In the absence of the aforementioned documents, the User acknowledges the right of a Sunday Village receptionist to refuse to provide temporary accommodation services until the proper document specified in this clause of the Agreement is presented.
6.2. If the User cancels the ordered service, or changes the start and/or end dates of the service for any reason beyond Sunday Village’s control, any change to the terms of the service initiated by the User after payment has been made shall be deemed a cancellation (partial cancellation) of the service by the User. In such a case, Sunday Village has the right to withhold (collect) from the User an amount equal to 100% of the cost of such service; if the User has prepaid for such service, the funds paid are non-refundable.
6.3. Upon check-in, the User is provided with a wristband (electronic access control wristband) for the cottage and is assigned parking spaces.
7. Accommodation for children
7.1. Children under 5 years of age stay free of charge, provided they do not occupy a separate bed or receive bedding. Children over 5 years of age are accommodated under the standard terms.
7.2. The rate for children over 5 years of age (at the time of check-in) is the same as the rate for an adult.
7.3. The terms for accepting and accommodating groups of children accompanied by adults are determined on a case-by-case basis.
7.4. Parents or persons accompanying children bear sole and personal responsibility for the behavior and safety of the children they are accompanying who are temporarily staying in Sunday Village cottages, Sunday Apart Hotel rooms, or Administration Rooms, including, but not limited to, during their stay anywhere on the Sunday Village premises or outside Sunday Village, during their stay on land or in a body of water, whether using swimming safety equipment or not, that is, in any case.
8. Accommodation of guests with pets
8.1. Pets (dogs, cats, etc.—hereinafter referred to as “pets”) are permitted on the Sunday Village premises. The Sunday Village administration reserves the right to determine whether a specific pet may be accommodated in a cottage or on the Sunday Village premises.
8.2. Accommodation with pets is permitted only in Sunday Village cottages. The Administration does not permit accommodation with pets in Sunday Apart Hotel rooms or other rooms.
8.3. The additional fee for accommodating a pet is 500 UAH per check-in and 100 UAH for each subsequent day of stay. In the event of non-payment of the pet accommodation fee or failure to notify the Administration of staying in a cottage with a pet, the User agrees to pay a penalty equal to double the cost of the pet’s accommodation no later than the day of departure.
8.4. Users and/or their guests who intend to stay with a pet must notify the Administration of this and strictly comply with all provisions governing the presence of pets on the Sunday Village premises; they shall bear full financial and legal responsibility for the pet with which they are staying.
8.5. The User and/or their guests who arrive at Sunday Village with pets (hereinafter referred to as the pet owner) are required to present the Sunday Village Administration with a veterinary health certificate indicating the pet’s vaccination status.
8.6. Walking medium and large dogs on the Sunday Village grounds is permitted only if they are wearing a muzzle and on a leash.
8.7. Walking pets on the lawns of the Sunday Village grounds is strictly prohibited. Pet owners are required to immediately clean up after their pets in the cottages or on the Sunday Village grounds every time. The pet owner must collect the pet’s feces and other waste in a special bag (either their own or one purchased at the Front Desk) and dispose of the bag and its contents in a trash can.
8.8. The pet owner agrees not to allow their pet to defecate on the greenery growing on the grounds of Sunday Village, or on furniture, curtains, walls inside the cottage, etc. Such actions shall be considered damage caused by the Sunday Village User, resulting in the application of the provisions of Section 8.13 of this Agreement to the User.
8.9. The pet owner agrees to feed the pet exclusively from special dishes intended for feeding animals (not included in the cottage’s amenities). It is prohibited to feed animals from dishes belonging to Sunday Village that are intended exclusively for human use.
8.10. It is prohibited to leave pets unattended by their owners.
8.11. It is prohibited to bathe pets in the cottages’ shower stalls or to use towels, sheets, and other bedding intended for human use on them.
8.12. The Sunday Village administration reserves the right to terminate this Agreement with a User (the provision of services to the User) who is staying in a cottage with a pet:
– in the event of a violation of the terms of this Agreement and the Rules of Stay;
– in the event of aggressive, inappropriate, or noisy behavior by the pet.
8.13. In the event that a pet damages or soils any property of Sunday Village, including the Sunday Village grounds, the User agrees to immediately and at their own expense restore the damaged property (return it to its original condition) or compensate Sunday Village for the cost of restoring the damaged property, or clean up the mess, or pay Sunday Village for the cost of cleaning up the mess, in accordance with Sunday Village’s rates/prices.
9. User rights and obligations
9.1. Under this Agreement, the User has the right to:
– use accommodation services and additional services in accordance with the procedures set forth in this Agreement and the Rules of Stay;
– receive complete and accurate information regarding access to the Sunday Village premises and the cost of services provided by Sunday Village;
– contact reception staff regarding the quality of temporary accommodation services, and submit complaints, feedback, and suggestions in the complaints and suggestions book located in the customer service area.
9.2. Under this Agreement, the User is obligated to:
– unconditionally and strictly comply with the terms of this Agreement and the provisions of the Rules of Stay, Equipment Rental Rules, Pool Usage Rules, and Water Safety Rules;
– respect the rights of other Sunday Village guests;
– adhere to moral and ethical standards and refrain from using profanity in the public areas of Sunday Village;
– observe quiet hours on the premises of Sunday Village: from 11:00 PM to 8:00 AM, loud noise, playing loud music, and loud conversations outside the cottage are prohibited;
– use Sunday Village’s infrastructure and amenities with care, and treat all Sunday Village property and third-party property located on the Sunday Village premises with respect. In the event of loss or damage to the aforementioned property due to the User’s fault, the User is obligated, within 3 (three) calendar days but no later than the date of check-out from the cottage, to compensate the property owner for the damage in the amount of the value of such property;
– comply with fire safety regulations and use Sunday Village’s electrical appliances and equipment in a reasonable (economical) manner.
9.3. The User’s rights and obligations are not limited to those specified in this section of the Agreement. The User has all rights and undertakes to fulfill all obligations set forth in other sections of this Agreement, the Rules of Residence, and the applicable laws of Ukraine.
10. Rights and obligations of Sunday Village
10.1. Under this Agreement, Sunday Village has the right to:
– enter the cottage, or the room(s) at Sunday Apart Hotel, or the room (rooms) of the Sunday Apart Hotel for the purpose of cleaning, changing bed linens, inspecting water supply, drainage, and air conditioning systems, or rectifying malfunctions in their operation, as well as in the event of a violation by the User of the provisions of this Agreement and the Rules of Stay;
– upon expiration of the User’s paid temporary accommodation period, to independently clear the cottage or rooms of the User’s personal belongings left behind after departure, while compiling an inventory of the movable property. The User’s property may be placed in paid secure storage under terms agreed upon with the User;
– in the event of more than two violations by the User of generally accepted standards of conduct and/or the terms of this Agreement and/or the Rules of Residence on the territory of Sunday Village, to call upon law enforcement officers or a community police officer to restore order.
10.2. Under this Agreement, Sunday Village undertakes to:
– provide the User with the services they have paid for in a timely, high-quality, and complete manner;
– inform the User about the services provided on the premises of Sunday Village, upon the User’s request;
– ensure that the services provided by Sunday Village fully comply with sanitary and epidemiological standards and regulations;
– respond promptly to User requests regarding the provision of temporary accommodation services, taking measures to repair malfunctions and address emergencies as quickly as possible;
– be responsible for the completeness and serviceability of equipment belonging to Sunday Village, as well as for the quality of the cottage’s preparation for check-in. Sunday Village is not liable for valuables, cash, documents, or any other material possessions of the User or their guests that were left on the premises of Sunday Village, or were lost or went missing for any reason.
10.3. Sunday Village reserves the right to terminate this Agreement early, without refunding any funds paid by the User, and to evict the User immediately in the event of one or more of the following violations:
– the User and/or their guests being in a state of severe alcohol intoxication and/or showing signs of drug and/or toxic intoxication;
– smoking in a cottage, or in a Room (rooms) of the Sunday Apart Hotel, or in a Room (rooms) of the Administration, as well as on the premises of Sunday Village, except in areas specifically designated for this purpose;
– storing weapons, explosives, flammable, corrosive, poisonous, or narcotic substances, and other dangerous objects and substances without the reception’s approval and without the necessary permits;
– violating public order rules, or failing to comply with or ignoring the instructions of the Sunday Village Administration;
– violating the Rules of Stay (Accommodation); a material breach of the provisions of this Agreement;
– systematic complaints from other temporarily accommodated persons regarding violations of their rights and freedoms by the User and/or their guests.
10.4. The rights and obligations of Sunday Village are not limited to those specified in this section of the Agreement but may also be defined in other sections of the Agreement and by the applicable laws of Ukraine.
11. Dispute resolution
11.1. In the event that a User has a complaint regarding the services provided to them, the User has the right to submit a written complaint to Sunday Village, accompanied by supporting documents confirming their stay at Sunday Village (receipt, invoice, etc.). Complaints and all necessary documents must be submitted by the User to Sunday Village no later than 5 (five) calendar days from the date the service was provided.
11.2. Sunday Village will review the complaint within 20 (twenty) calendar days from the date of receipt of a properly submitted complaint.
11.3. Complaints filed in violation of the terms of this Agreement and/or anonymous complaints will not be considered.
11.4. In the event that an agreement cannot be reached, disputes shall be resolved in court at the location of Sunday Village. The statute of limitations is 1 year.
12. Additional services
12.1. In addition to temporary accommodation services, Sunday Village provides the following services free of charge:
– cleaning the interior of the cottage after checkout;
– calling emergency services;
– use of kitchen equipment, tableware, electrical appliances, and other everyday items, equipment, and facilities of Sunday Village (except for those provided on a paid basis);
– wireless Internet access;
– use of the barbecue located near the cottage where the User is staying (if available near the cottage);
– use of the children’s playground, sports field, recreation area, beach area, pool area, pontoons, walking paths, and parking lot.
12.2. Other additional services are provided at Sunday Village’s rates/prices.
13. Force majeure
13.1. In the event of force majeure circumstances arising on the date of acceptance of this Agreement and/or during its performance, including: floods, earthquakes, fires, strikes, epidemics, martial law, the imposition of a curfew, evacuation measures, the declaration of a state of emergency, missile and air strikes and their consequences, decisions by government authorities in connection with armed aggression against Ukraine, changes in legislation, etc., Sunday Village/the User shall be partially or fully exempt from fulfilling their obligations under this Agreement to the extent affected by such a force majeure event, provided that the Party complies with the conditions of Section 13.2.
13.2. Sunday Village/the User, for whom it has become realistically and objectively impossible to fulfill the obligations assumed due to force majeure circumstances, is obligated to immediately, no later than two calendar days from the occurrence of such circumstances, in writing or via electronic means, notify the other Party of the time of the occurrence and cessation of such circumstances.
13.3. The occurrence of force majeure must be confirmed by the relevant competent authority. In times of war, confirmation of force majeure shall be provided by a certificate from the Ukrainian Chamber of Commerce and Industry or by relevant decisions of state authorities.
13.4. In the event of unforeseen circumstances, Sunday Village employees or the administrator have the right to enter the cottage at any time of day or night without hindrance in order to prevent negative consequences, including preventing or extinguishing a fire, electrical short circuits, flooding from water or sewage, providing assistance to a person in danger, stopping a violation, or preventing a crime, etc.
14. Other provisions
14.1. This Agreement constitutes a public offer; therefore, the User and Sunday Village acknowledge its validity from the moment the Agreement is concluded (upon the User’s acceptance).
14.2. If, prior to the conclusion of the Agreement (acceptance), the User expresses a desire to make changes to the content of this Agreement, they must send Sunday Village a corresponding letter containing an exclusive list of changes, on the basis of which Sunday Village will review them within 10 days.
14.3. The following are annexes and integral parts of this Agreement: the Rules of Stay, Rental Rules, Rules of Conduct at the Pools, Hydro-Massage Tubs, Children’s Aqua Zone, and the Riverside Area, Registration forms (completed and signed by the User), notices posted on the Sunday Village website, as well as informational brochures, stands, price lists, rates, tariffs, announcements, and signs located in the cottages and on the Sunday Village premises.
14.4. Other provisions not covered in this Agreement are governed by the current legislation of Ukraine. In the event of any discrepancies between the Ukrainian and foreign language versions of this Agreement posted on the Sunday Village website, the Ukrainian-language version shall prevail.
