We invite you to review the terms of this Rental Agreement, which constitutes our public offer to you, and to enter into it with the service provider.

1. General grovisions for acceptance of a car rental agreement

1.1. The Rental Agreement (public offer) (hereinafter referred to as the “Agreement” or “Public Offer”) sets forth the essential terms in accordance with Article 641 of the Civil Code of Ukraine and constitutes an official public offer by Sunday Village, addressed to other adults identified by the personal data specified in the Logbook for the Issuance of Rental Equipment and Completion of Safety Training (hereinafter referred to as the “User”), which in turn constitutes an annex to this Agreement.

1.2. Sunday Village and the User mutually warrant that they possess the necessary legal capacity, as well as all rights and powers necessary and sufficient to enter into and perform this Agreement under the terms set forth below.

1.3. The text of this Agreement is posted on the official Sunday Village website at the following link: https://sunday-village.com.ua/ (hereinafter referred to as the “Sunday Village website”) and constitutes the official and current version of this Agreement.

1.4. In accordance with the Law of Ukraine “On the Protection of Personal Data” No. 2297-VI, the User grants Sunday Village consent to process their personal data to the extent necessary for the provision of services under this Agreement. Purpose of processing: to identify the User during rental, ensure security, and resolve potential disputes. Retention period: 1 (one) year from the date of rental expiration. The User has the right to withdraw consent in writing by contacting sundayvillage.manager@gmail.com.

1.5. Acceptance of the Public Offer is deemed to occur when the User performs any of the following actions:

– payment for Sunday Village rental services;

– directly using Sunday Village rental services;

– signing the Rental Equipment Logbook and completing safety training (hereinafter referred to as the “Logbook”).

1.6. The conclusion of this Agreement means that the User:

– has fully read, agrees to, and accepts all the terms of this Agreement and the Rules for the Use of Rental Equipment;

– is personally responsible for themselves and any persons who will be on the rental vehicle (or vehicles) issued to the User;

– bears full financial responsibility for the safety of the rental vehicle (or vehicles) for the duration of its (their) use.

2. Subject matter of the rental agreement

2.1. Sunday Village provides the User, for a fee, with temporary use of the following rental equipment from the list below, at the User’s discretion:

– a catamaran and its accessories (life jackets are provided free of charge);

– a four-wheeled gasoline-powered ATV (hereinafter referred to as the “ATV”) and its accessories (a helmet is provided free of charge);

– a recreational bicycle (hereinafter referred to as the “bicycle”);

– a scooter and its accessories;

– a stand-up paddleboard and its accessories (life jackets are provided free of charge);

– a kayak and its accessories (life jackets are provided free of charge);

– a boat and its accessories (life jackets are provided free of charge);

– other rental equipment available at the time of rental may be provided under this Agreement.

2.2. The cost of rental equipment and accessories provided to the User is determined by Sunday Village in its price list. The cost of repairing rental equipment damaged through the User’s fault is determined based on the Inspection Report (Section 5.9 of this Agreement) and Sunday Village’s current price list.

2.3. By signing the Logbook, the User confirms that the rental equipment, accessories, and gear provided by Sunday Village are in good working order and undamaged at the time of issuance to the User.

2.4. By signing the Logbook, the User confirms that they bear full financial liability for damage to or loss of the rental vehicle and/or accessory or equipment at the cost specified in the price list.

2.5. By signing the Logbook, the User confirms that they and their passengers are familiar with and agree to comply with the Rules for Using the Rental Vehicle (Safety Rules).

2.6. By signing the Logbook, the User certifies that he and his passengers have no medical contraindications for using the rental vehicle.

2.7. The User agrees to pay Sunday Village the rental fee in accordance with the price list.

3. Payment and rental procedures

3.1. For the use of the rental vehicle provided under this Agreement, the User shall pay Sunday Village a rental deposit in the amount specified on the website sunday-village.com.ua, in the price list, in the brochure, in advertisements, on the display at the rental location, at the Sunday Village Administration, etc. The fee is charged for the duration of the rental vehicle’s use and may be calculated by Sunday Village on an hourly basis in each individual case.

3.2. Payment method: cash or non-cash.

3.3. The User is required to present a document verifying their identity and age. The Sunday Village employee responsible for rentals has the right to photograph or photocopy the User’s document for rental processing.

3.4. For the rental period, a User who does not reside in a Sunday Village cottage is required to leave a cash deposit of at least 20% of the rental vehicle’s cost as per the price list, or provide a copy (photocopy) of an identity document. Original identity documents are not retained. The deposit is returned to the User in full upon the return of the rental vehicle in good condition.

4. Sunday Village’s rights and responsibilities

4.1. Sunday Village has the right to use photos and video materials obtained while the User is using rental equipment for advertising or other commercial purposes only with the User’s express consent. Such consent is provided by the User by signing the appropriate box in the Rental Equipment Log. The absence of a signature under this clause constitutes the User’s refusal to allow the use of their image.

4.2. Sunday Village has the right to refuse to rent out equipment if it observes signs of alcohol and/or drug intoxication, or if there are signs that a person is under the influence of psychotropic substances, or if a person’s physical condition may prevent the safe operation of the rental equipment by the User and/or their passengers.

4.3. Sunday Village undertakes to provide only a roadworthy rental vehicle for use.

4.4. Sunday Village undertakes to perform major and routine repairs of rental vehicles at its own expense, unless it proves that the damage to the vehicle occurred through the User’s fault (in accordance with Article 791, Part 3 of the Civil Code of Ukraine).

5. User rights and responsibilities

5.1. The user has the right to rent one or more rental vehicles.

5.2. The user has the right to operate an ATV at their own risk, provided they hold a valid driver’s license, strictly adhere to the Rules of the Road, and refrain from driving on public roads. The user is required to follow the route led by the escort (a designated Sunday Village employee) without deviating from the route. A helmet is mandatory. Responsibility for the safety of a child passenger rests entirely with the adult escort. Responsibility for riding with a child rests with the parents or their legal guardians.

5.3. The user is required to personally inspect the rental vehicle before use and independently verify the serviceability of the equipment and accessories received.

5.4. The user agrees to take all necessary measures to preserve the integrity of the rental equipment and is responsible for its loss or damage.

5.5. The User agrees to reimburse Sunday Village for the cost of repairs to damage caused by the User’s negligence or intentional acts, or for the cost of the rental vehicle lost by the User, based on the Inspection Report (Section 5.9 of this Agreement).

5.6. The User agrees to return the rental vehicle to Sunday Village in a condition no worse than when it was received for use (including accessories and equipment).

5.7. The User has the right to terminate the Agreement at any time by notifying a responsible Sunday Village employee of their intention and returning the rental vehicle. In such a case, the rental fee shall be recalculated proportionally to the actual time of use of the rental vehicle in accordance with Article 790 of the Civil Code of Ukraine. The difference between the amount paid and the cost of actual use shall be refunded to the User immediately.

5.8. The User is obligated to use the rental item for its intended purpose, not to repair it independently, and not to make any changes to its structure.

5.9. If a rental vehicle is returned with damage, a designated Sunday Village employee will inspect it and prepare an Inspection Report in the presence of the User. The report must be signed by both parties. If the User refuses to sign, the Report is drawn up in the presence of two witnesses with a note of refusal. The Inspection Report is the sole basis for filing a claim against the User for compensation for damages. Sunday Village files such a claim no later than 24 (twenty-four) hours after the return of the rental vehicle.

6. Safety rules, safe operation, and additional rental terms

6.1. The User and their passengers are required to comply with traffic laws, rules of conduct on the water, Ukrainian law, and the provisions of this Agreement, taking into account the type of rental vehicle.

6.2. The rules for using rental vehicles (safety rules) constitute an integral part of this Agreement; they are posted on the Sunday Village website, and a printed version is available at the rental location and at the Sunday Village Administration.

6.3. In the event that the User or their passengers violate the provisions of this Agreement and/or the Safety Rules, which, in the opinion of a Sunday Village employee, may result in injury to persons or damage to the rental vehicle, the Sunday Village employee has the right to unilaterally terminate this Agreement early and immediately – the rental vehicle must be returned immediately. The fee for the time actually used shall be retained by Sunday Village. The balance of the amount paid for the unused time shall be refunded to the User. Additionally, Sunday Village has the right to impose a penalty equal to the cost of 30 (thirty) minutes of rental of the relevant vehicle for each instance of violation.

6.4. If the return was effected by forcibly towing the catamaran with a boat, the User agrees to reimburse Sunday Village for the towing costs in accordance with the price list.

6.5. Neither Party shall be liable to the other for failure to perform its obligations under this Agreement due to force majeure events arising beyond the control of the Parties, including: natural disasters, floods, fires, earthquakes, epidemics, martial law, the imposition of a curfew, the declaration of an air raid alert, missile and air strikes and their consequences, evacuation measures, decisions by state authorities in connection with armed aggression against Ukraine, as well as other unforeseeable circumstances. Force majeure shall be confirmed by a certificate from the Ukrainian Chamber of Commerce and Industry or relevant decisions of state authorities. The Party affected by force majeure shall notify the other Party thereof no later than 2 (two) calendar days from the occurrence of such circumstances.

7. Dispute resolution

7.1. All disputes or disagreements arising between the Parties under this Agreement or in connection therewith shall be resolved through negotiations between the Parties.

7.2. If the disputes cannot be resolved through negotiations, they shall be subject to judicial review in accordance with the procedure established by law.

7.3. The statute of limitations for claims arising from this Agreement is 1 (one) year in accordance with Article 786 of the Civil Code of Ukraine.

9. Actions to take when an air raid alarm is sound

9.1. When an air raid alarm is sounded, the User must immediately stop using the rental equipment and return to the rental location or the nearest shelter within Sunday Village.

9.2. Watercraft (catamarans, kayaks, SUP boards, boats) must be returned to shore immediately. ATVs and bicycles must be returned to the rental station area.

9.3. Sunday Village has the right to suspend rental services for the entire duration of the alert and for 30 (thirty) minutes after the all-clear is announced. The duration of the alert is not included in the rental time and is not charged to the User.

9.4. A map showing the locations of the nearest shelters is posted on information boards throughout the Sunday Village grounds.
